Terms and conditions of access and use (2022 and 2023)
Premises
The terms and conditions set forth herein (“T&C”) govern access to, and use of, the website https://www.diagnosticmindset.com/ (the “Site”), owned by Giliola Spattini & C – Società tra Professionisti, via Ducale 1101 – Frazione Saltino 41048 Prignano sulla Secchia (MO) Italia P. IVA 03787680366 (the “Company”).
By accessing the Site, the User agrees to be bound by these Terms and Conditions and by the Data Protection and Cookie Policy document, which must be considered an integral part of the same.
The Company may, from time to time, modify and/or supplement the T&C and/or the Data Protection and Cookie Policy document. In this case, the modified and/or integrated version will be effective immediately after publication on the Site.
By accessing, and using, the Site after such publication, the documents will be deemed known to the user.
1. DEFINITIONS
“Date of Acceptance“: the date on which the Company receives the registration form from the User.
“Products” mean any article, video, image, individually and cumulatively, as well as any other product conceived and developed by the Company and present on the Site.
“User” means the user registered on the Site.
“User Data” mean all digital and electronic data or information sent by the User to the Company.
“Personal Data” mean any information relating to a natural person, identified or identifiable, directly, or indirectly, by means of a name, an e-mail address, or one or more specific aspects of physical, economic, cultural, or social identity.
“Confidential Information” means all information identified as confidential by the User and communicated in writing to the Company.
“Registration Form” is the form to be completed to register on the Site and purchase the Products and /or access the use of the same.
“T&C” means these Terms and Conditions.
2. OBLIGATIONS OF THE USER
The User is solely responsible for: (i) the accuracy, truthfulness, integrity, and lawfulness of the User Data communicated through the Registration Form; (ii) to prevent unauthorized access or use of the Site through your credentials; to promptly inform the Company of the theft or loss of their credentials; (iii) access to and use of the Site and Products in accordance with these T&Cs and the law.
It is expressly forbidden for the User to (i) allow third parties to access the Site with their credentials; (ii) create derivative works based on the contents of the Site; (iii) copy or transmit the contents of the Site for uses other than copying or redirecting to your intranet or your organization’s internal use; (iv) access the Site in order to (a) build a competitive product or service or (b) copy any functionality and function or graphics of the Site; (vi) remove or destroy any copyright notice or other proprietary markings; (vii) to resell the Products through its website or physical store without the prior written consent of the Company.
In case of non-compliance with the obligations and prohibitions detailed herein, the Company may without limitation with respect to the exercise of other rights and the exercise of further remedies, suspend the User’s access to the Site.
3. PERSONAL DATA
By completing the Registration Form, the User accepts the conditions of access to and use of the Site.
During the registration phase on the Site, the User may provide Personal Data. In this case, the User undertakes to provide true, accurate and complete information about himself and to update the information in the event of a material change.

If the User provides untrue or inaccurate, outdated, or incomplete information, or if the Company has a well-founded suspicion that the information provided is false, inaccurate or incomplete, the Company may, in its sole discretion, suspend, terminate or refuse future access to the User.
4. CONFIDENTIAL INFORMATION
Your Data may contain Confidential Information.
To protect your Confidential Information, the Company will use the same degree of protection it uses to protect the confidentiality of its confidential information (in no case less than reasonable care) and undertakes (i) not to use any User Confidential Information for any purpose other than what is necessary for the use of the Site and the Products and (ii) unless otherwise authorized in writing by the User, to limit access to the Confidential Information of the same to those of its employees, contractors or agents who need it for purposes consistent with the use of the Site and the Products by the User.
Notwithstanding the foregoing, the Company may disclose your Confidential Information if such obligation arises from the law or the order of a competent authority.
No information that (i) is or becomes generally known to the public without breach of any obligation to you, (ii) was known to the Company prior to its disclosure by you without breach of any obligation to you, (iii) is received by a third party without breach of any obligation to you, or (iv) has been independently learned by the Company may qualify as Confidential Information.
All Data provided by the User to the Company will remain the property of the User who provided it. the Company may make copies of your Data to the extent reasonably necessary to perform the relevant services.
5. LIMITATION OF LIABILITY
the Company makes no warranty, express, implied, or conventional, in relation to the services provided, and about the uninterrupted or error-free operation of the site.
the Company may, in its sole discretion, terminate your access or remove your User Data, or information you provide if you access and use the Site other than as provided herein, as well as for any violation of these T&Cs or applicable law.
6. APPLICABLE LAW AND JURISDICTION
The law applicable to these T&Cs, as well as any matter relating to them, including access to and use of the Site, is the Italian one. Any questions that may arise regarding the interpretation, execution or in any way related to the same will be devolved to the exclusive jurisdiction of the Court of Milan (Italy).
